Restroom Alert, LLC (“Restroom Alert”, “we”, “us” and terms of similar meaning) provides this web site and the services provided by or through this web site to you subject to these terms and conditions of use (these “Terms”).

In these terms we call this web site, any successor web sites (together, the “Site”) and the software we provide the “Application”. The Application includes mobile applications (Apps), third parties authorized through your Restroom Alert account to use your User Content (as defined below), and any software or services provided for use with the Application. We refer to the services provided by the Application as the “Services”.

Please read these Terms carefully before using the Services. By accessing or using the Services you agree to be legally bound by these Terms and all terms, policies and guidelines incorporated by reference in these Terms. If you do not agree with these Terms in their entirety, you may not use the Services.

The Services are not intended to be used by children. You must be at least of the age of majority to use the Services.

In these Terms, our customers and their staff members to whom they give “staff” access to their Restroom Alert account are called “Subscribers”, and our customers’ customers who use the Services (for example, to send text alerts, emails and other messages) are called “Customers”. In these Terms users of the Services, whether they are Subscribers, Customers, people who post comments on the Restroom Alert blog, or casual browsers of the Site, are called “Users”.

Restroom Alert reserves the right to change or modify any of the terms and conditions contained in these Terms, or any policy or guideline applicable to the Services, at any time and in its sole discretion. If we do so, we will notify you at the email address you provide in your registration information, if any. If you do not agree with the changes, you can cancel your account with us without further obligation, except for the amount due for the balance of the billing period in which you cancel your account (if your billing period is monthly, we will prorate your account to the nearest month-end after cancellation). Unless otherwise specified, any changes or modifications will be effective immediately upon posting of the revisions on the Site, and your continued use of the Services after such time will constitute your acceptance of such changes or modifications. You should from time to time review the Terms and any policies and documents incorporated in them to understand the terms and conditions that apply to your use of the Services. The Terms will always show the ‘last updated’ date at the top. If you do not agree to any amended Terms, you must stop using the Services. Program Description
Restroom Alert’s SMS program, Restroom Alert (RA), is designed to help the public inform facilities services of restroom conditions in real-time. By subscribing to this program or sending a text message to our system, you may receive messages related to:

Confirmation of receipt
Notifications and reminders about public feedback
Notifications about maintenance schedules

The Services are for your own use only. You may not resell, lease or provide them in any other way to anyone else, except as expressly permitted through the Application.

1. When you opt-in to the service, we will send you an SMS message to confirm receipt of your feedback.

2. You can cancel the SMS service at any time. Just text “STOP”. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. Once you “STOP”, you may NOT re-join.

3. If at any time you forget what keywords are supported, just text “HELP”. After you send the SMS message “HELP” to us, we will respond with instructions on how to use our service as well as how to unsubscribe.

4. We are able to deliver messages to the following mobile phone carriers:

Major carriers: AT&T, Verizon Wireless, Sprint, T-Mobile, MetroPCS, U.S. Cellular, Alltel, Boost Mobile, Nextel, and Virgin Mobile.

Minor carriers: Alaska Communications Systems (ACS), Appalachian Wireless (EKN), Bluegrass Cellular, Cellular One of East Central IL (ECIT), Cellular One of Northeast Pennsylvania, Cincinnati Bell Wireless, Cricket, Coral Wireless (Mobi PCS), COX, Cross, Element Mobile (Flat Wireless), Epic Touch (Elkhart Telephone), GCI, Golden State, Hawkeye (Chat Mobility), Hawkeye (NW Missouri), Illinois Valley Cellular, Inland Cellular, iWireless (Iowa Wireless), Keystone Wireless (Immix Wireless/PC Man), Mosaic (Consolidated or CTC Telecom), Nex-Tech Wireless, NTelos, Panhandle Communications, Pioneer, Plateau (Texas RSA 3 Ltd), Revol, RINA, Simmetry (TMP Corporation), Thumb Cellular, Union Wireless, United Wireless, Viaero Wireless, and West Central (WCC or 5 Star Wireless).

***Carriers are not liable for delayed or undelivered messages***

5. As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive 1 confirmation message per feedback message sent to us. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
